Rules of ticket reservation and sale

1.GENERAL PROVISIONS
1.1. These Rules of Ticket Reservation and Sale at the Novaya Opera’s Website (hereinafter referred to as the Rules) contain the main provisions governing relations between the Buyer (Spectator) and the Seller (the Kolobov Novaya Opera Theatre of Moscow, hereinafter referred to as the Theatre) during the sale of tickets at the Novaya Opera’s official website http://www.novayaopera.ru (hereinafter referred to as the Website).
1.2. These Rules shall take effect from the time the User registers on the Theatre’s Website and shall govern relationships between the User as Buyer and the Theatre as Seller with regard to online ticket reservation and purchase at the Theatre’s Website.
1.3. These Rules are an integral part of the Theatre’s offer to the public to purchase tickets for its Events at the Website. By agreeing to the Rules, the User shows his/her full and unconditional acceptance of their provisions. The User’s acceptance of the terms and provisions contained in the Rules is shown by pressing the relevant button on the Website during primary registration on the Theatre’s Website.
1.4. By registering on the Website and pressing the relevant button, the User agrees to the conditions of providing his/her personal data to the Theatre, selects the option for receiving the Theatre’s newsletters and advertisements at the e-mail address registered on the Theatre’s Website.
1.5. As part of the registration process the User shall indicate his/her first and last names (as indicated in the User’s passport) in the relevant boxes of the application form on the Website and his/her e-mail address and phone number and enter the password, after which the online ticketing system automatically generates and sends to the User’s registered e-mail address a letter with a code necessary for the completion and confirmation of the registration.
 

1.6. To recover the lost password the User can press the relevant function button on the Website.
1.7. The User shall be responsible for all actions undertaken in his/her name on the Website and shall immediately notify the Theatre of any unauthorized use of his/her name by any means available.
1.8. After completing the registration, the User shall be entitled to purchase online tickets for the performances available for sale on the Website.
1.9. As per Paragraph 3 of Article 438 of the RF Civil Code, by paying for tickets the User shows his/her full acceptance of the Theatre’s offer, which amounts to entering into an agreement on compensated rendering of services in the cultural sector.
1.10. The Theatre shall reserve the right to make amendments to these Rules without additional notice to the User and hereby notifies the User (and the User hereby accepts and agrees) that when making a new order he/she shall be obliged to read the text of the Rules in order to see any amendments. 1.11. In view of the foregoing, read carefully the text of the public offer and in case you disagree with any clause of the offer, you may opt out of purchasing and/or using the services offered by the Theatre.

2. TICKET RESERVATION AND SALE
2.1. Tickets for the Theatre’s performances may be paid for on the Website by means of their purchase or booked on the Website without payment to be subsequently bought at the Theatre’s box-office.
2.2. Tickets bought at the Website are a digital record in the database of the Theatre’s ticket record-keeping system, which contains information identical to the information on the attributes of a ticket that is allowed for distribution and sale by the given entertainment establishment and a personal identification number (PIN-code). The purchase of tickets is confirmed by an electronic certificate (hereinafter, the Certificate). The Certificate cannot be used to enter the Theatre and attend an event and is to be exchanged for tickets (paper tickets) at the Theatre’s box-office.
2.3. Ticket reservation shall be done in accordance with the Booking Instruction placed on the Website at

2.4. To buy tickets online at the Theatre’s Website the User shall have a valid international bank card – VISA International or MasterCard World Wide.
2.5. To buy a ticket the User shall log in to the Theatre’s Website using his/her name and password and select events he/she would like to attend at a convenient date and time (available events are marked TICKETS). Information on the possibility to buy tickets online will be highlighted under the TICKETS mark.
2.6. The seats selected from the seating chart are formed into an order (reservation). An order shall be valid for 3 days including the day of reservation. Within this time period the tickets can be bought at the Theatre’s box-office or paid on the Theatre’s Website by bank card. On expiration of the indicated period, the tickets that have not been paid for any reason will be automatically canceled by the system.
 

2.7. One User can reserve not more than 4 (Four) unpaid tickets for an event.
2.8. An order shall be bought at the Theatre’s box-office or paid on the Theatre’s Website only in full. Should the User want to opt out of buying some of the reserved tickets, he/she shall delete them from the order before payment.
2.9. After confirmation of payment the User will receive an e-mail containing a receipt and the Certificate. The Certificate will also be accessible on the User’s personal account on the paid order page. The electronic Certificate is to be obligatorily exchanged for tickets at the Theatre's box-office. Admission to the Theatre’s events shall be allowed only to holders of tickets received at the box-office. An electronic Certificate shall not give the right of admission to an event.
2.10. To collect the tickets paid for on the Theatre’s Website the Buyer shall present the Certificate confirming the purchase of tickets at the Theatre’s Website, a filled-in ticket Receipt which is part of the Certificate, and the Buyer’s identification document. In the absence of the printed Certificate, the tickets can be collected using the order number or the pin-code. The tickets can be collected at the Theatre’s box office during the opening hours or before the performance, but not later than 40 minutes before its beginning.
2.11. Discounts on tickets granted to individuals under the existing laws can be used by them only when purchasing tickets at the Theatre’s box-office.
2.12. A single order shall contain tickets for only one event.

3. RIGHTS AND OBLIGATIONS OF THE THEATRE
3.1. The Theatre shall use the information provided by the User only for organizing the Website’s functioning.
3.2. The Theatre shall have the right to refuse to issue original tickets to the User if:
3.2.1. It is not possible to identify the User and there are doubts as to the authenticity of his/her documents (until uncertainty is cleared up);
3.2.2. The User comes to collect tickets at the box-office after the Performance has begun;
3.2.3. Information comes from the Payment System as to a committed or suspected fraud with the use of the User’s bank card (until the payment is refunded to the User’s bank card).
3.3. The Theatre shall have the right to limit the User’s access to the Website in case of violation of the established rules.
 

3.4. The Theatre shall have the right to stop at any time the operation of its Website without prior notice to the User. The Theatre shall not be responsible for temporary or permanent suspension of its Website service.
3.5. The Theatre shall not be held responsible for any direct or indirect losses arising from   use of, or inability to use, its Website, or as a result of non-sanctioned access to its Website.
3.6. The Theatre shall not be responsible for the timing of payment operations, including refunds, by the Payment System or by banks and other organizations.
3.7. The Theatre’s liability to the User shall be limited to the cost of purchased tickets; any disputes between the Theatre and the User shall be settled through negotiation or, should this be impossible, they shall be resolved in accordance with the Russian legislation.

4. TICKET REFUND RULES
4.1. In case of lateness for or non-attendance at an event for any reason the Theatre does not refund the price of the ticket to a Customer.
4.2. In case of cancellation, replacement or postponement of an event the Buyer shall have the right to return the purchased tickets and to claim a refund of the money paid. Returned tickets shall be reimbursed according to the prices indicated on the tickets. To apply for money refunds to a bank card, the Buyer shall fill in a form of “request for ticket refund” that can be obtained at the Theatre’s box-office.
4.3. The Buyer shall have the right to return a ticket purchased for an event to the Theatre’s box-office at any time before the beginning of the event.
 

4.4. Refunds for tickets purchased with bank cards shall be made to the same card from which the tickets were paid for, within the time and according to the rules established by the issuing bank.
4.5. In case of cancellation of a performance, ticket return shall be done from the day when the cancellation is announced till the scheduled date of the performance, plus 10 (Ten) calendar days.
4.6. Information on replacement or cancellation of an event and on terms of ticket return shall be posted in a place accessible for spectators at the Theatre’s box-office and on the Website.
4.7. An unused ticket for an event cannot be used for admission to other events.
